These terms are here to outline what you can expect when working with me (Frontenac Photography), and what I need in return to provide the best possible experience for everyone involved.

 

They’re not meant to feel overwhelming or restrictive—just honest, transparent, and supportive. If you ever have questions or need clarification, I’m always happy to walk through things with you.

This page exists to protect each of us and the story we capture together.

Terms & Conditions

Frontenac Photography

​

These are a set of blanket Terms & Conditions that apply to all photography services provided by Frontenac Photography. They exist to create clarity, protect everyone involved, and support a respectful, smooth experience from start to finish.

1. Copyright & Use of Images

Under Canadian copyright law, the Photographer retains full copyright ownership of all images created.

Frontenac Photography reserves the right to use select images for portfolio, marketing, and promotional purposes, including but not limited to the website, social media platforms, and printed or digital materials.

If clients prefer their images not be shared publicly, this must be communicated in writing prior to the session or event.

Client Usage Licence

Clients are granted a non-exclusive, personal-use licence to download, print, and share their images for personal use.​

Images may not be sold, altered, entered into contests, or used for commercial purposes without prior written permission from the Photographer.

2. Services Provided

Photography services may include, but are not limited to:

  • Photography coverage for the agreed-upon duration

  • Gentle posing guidance and direction, where appropriate

  • Professional editing in Frontenac Photography’s signature style

  • Delivery of final images via a private online gallery

  • Temporary storage of images (see Section 3)

 

Photography Coverage

Coverage is provided for the duration outlined in the selected package or service agreement. As photography sessions and events are live and unscripted, Frontenac Photography is not responsible for factors beyond control, including subject/guest behaviour, environmental conditions, venue restrictions, lighting challenges, or schedule delays.

 

Editing of Images

Editing includes colour correction, exposure adjustments, contrast, clarity, and artistic finishing consistent with Frontenac Photography’s style.

Basic retouching may include removal of minor blemishes or small background distractions. Extensive retouching, body alterations, or object removal are not included unless discussed in advance.

A combination of colour and black & white images may be delivered.
Any stated image quantities are estimates only and are not guaranteed, as final image count depends on session length, subject cooperation, and event flow.

3. Delivery & Storage of Images

Final images will be delivered within the timeframe outlined in the service agreement or package description. Unless otherwise stated in writing. 

Images are delivered via a private, password-protected online gallery shared by email.

Galleries remain active for 90 days from the delivery date.

Clients are responsible for downloading and securely storing their images before gallery expiration.

Gallery Expiry & Reactivation

A reminder email will be sent approximately 24 hours before gallery expiration.

If a gallery expires before images are downloaded, reactivation is available for a fee of $100, payable prior to reactivation.

Reactivated galleries remain open for 7 days.

Frontenac Photography is not responsible for storing images beyond four (4) months after gallery expiration.

4. Booking & Payments

To confirm a booking, clients must:

  • Sign the applicable photography service contract

  • Pay a non-refundable, non-transferable deposit stated in the service contract

 

The remaining balance is due no later than 48 hours prior to the scheduled session or event, unless otherwise agreed to in writing.

 

A late payment fee may apply if payment is not received by the due date. Editing and image delivery will not begin until full payment has been received.

5. Additional Fees & Add-Ons

The following may be added to any photography service and are subject to availability:

  • Travel: $0.61/km for locations outside Kingston, Ontario

  • USB Image Delivery: $50

 

All add-ons must be requested and confirmed in advance.

6. Cancellations

By the Client

Cancellations must be provided in writing. Deposits are non-refundable under all circumstances.

Additional payments beyond the deposit may be non-refundable due to preparation, scheduling, and reserved time.

By Frontenac Photography

In the unlikely event that Frontenac Photography must cancel due to illness, emergency, or circumstances beyond control, the client will be notified as soon as possible and all payments received will be fully refunded. Liability is limited to the return of payments only.

 

7. Treatment of Photographer & Equipment

Clients and their guests are expected to treat the Photographer, assistants, and all equipment with care and respect.

Photography equipment may not be handled or operated by clients or guests at any time.

Clients are responsible for ensuring children and guests do not interfere with or damage equipment.

Any damage caused to equipment by clients or their guests will be the financial responsibility of the client.

Disrespectful, aggressive, or inappropriate behaviour will not be tolerated and will result in immediate termination of services and products without refund.

 

8. Limitation of Liability

While every effort is made to deliver high-quality images, Frontenac Photography is not responsible for circumstances beyond control, including but not limited to weather conditions, lighting limitations, venue restrictions, schedule delays, or subject/guest interference.

The Photographer’s total liability for any claim related to services or products is limited to the total fees paid by the client.

Frontenac Photography is not liable for indirect, incidental, or consequential damages.

 

9. Privacy & Personal Information

Client information is collected solely for the purpose of communication, service delivery, and gallery access.

Personal information will not be shared with third parties except where required to fulfill contracted services (such as professional labs or gallery hosting platforms), and will be handled in accordance with applicable Canadian privacy laws.

 

10. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada.

11. Agreement

By inquiring  with Frontenac Photography and signing the applicable booking service contract, clients acknowledge that they have read, understood, and agreed to these Terms & Conditions.
